Conditions of chartering with Compass Charters Ltd

1.

Cancellations :

a) Cancellations 30 days prior to charter commencement, a full refund will be given less $250 cancellation fee and card processing fee (if applicable). 
b) Cancellations less than 30 days from commencement date will receive a full refund less $250 cancellation fee and card processing fee only if an alternative charter to the same value can be arranged.

Compass Charters Ltd reserves the right to cancel a charter.

  • If for a specific reason a vessel can not be made available for charter.
  • Adverse weather conditions.
  • If Compass Charters Ltd at the charter commencement are not satisfied with the ability of the charterers to sail, handle, navigate and respect the charter vessel, or alternatively at any time during the charter period consider the vessel to be in an unsafe location, or if the actions of the charterers are endangering the vessel, its occupants or any third party. Compass Charters Ltd reserves the right to either: Provide a professional skipper at the charterer's expense, terminate the charter without refund, recall the vessel to any mooring or anchorage which it considers to be secure.
3. Vessels must remain in the designated survey area at all times with numbers of people not exceeding number allowed onboard under the vessels survey. All charters commence from the marina berth at 9am on the start day and must depart the vessel by 9am on the finish day. Or the charterer can elect to start and return the vessel between 9am and 4pm on 24 hr multiples and return the vessel with the boat in the "state it was found in". I.e. if you have a 3 day charter and you start at noon on Monday then you need to depart the vessel at noon on the Thursday.
 
4. Vessels must be secure on anchor or a mooring by 6pm or 2hrs before darkness. All moorings are used at the skippers own risk and discretion. Compass Charters are not to be held responsible for any damage or loss due to mooring/gear failure as it is impossible to monitor the daily condition of the moorings shown in the Compass Charters manual. Vessels must not manoeuvre within the hours of darkness unless in an emergency or permitted by Compass Charters by prior arrangement. 
 
5. Charterers must adhere to current M.A.F. fishing regulations.
 
6. No animals/pets allowed on charter vessels.
 
7. No firearms allowed on charter vessels unless aranged prior.
 
8. Smoking is not permitted inside any vessel.
 
9. All rubbish must be returned to the marina for disposal.
 
10.

The skipper or person in control of the vessel will not consume alcohol or any judgement imparing drugs during the hire period.

11. The charter vessel must at all times for the charter period, be under the control of the designated skipper.
 
12. A minimum charter period of 4 days (5 days for some vessels) for parties departing Waikawa Marina to Pelorus Sound or d'Urville Island unless prior permission has been granted by Compass Charters Ltd.
 
13. The skipper must be a minimum of 21 years of age for vessels under 30 feet and 25 years of age for vessels 30 feet and over unless specifically agreed upon by Compass Charters Ltd.
 
14. Everyone will have to abide by the Maritime Rules and Regulations. 


Conditions of payment:

1. A booking is confirmed after the payment of a deposit of 1/3 of the basic charter fee and satisfactory completion of booking form / details. The balance of the charter is to be paid 30 days prior to the charter commencing during the PEAK season and on arrival to the charter commencing during the SHOULDER and ECONOMY seasons.

Self-drive charters:
The security bond is to be paid by credit card/cash/Bank Cheque prior to or on arrival for the charter. Security Bond is $2500 for launches and yachts , $4500 for Panache Cat and Andromeda and $1200 for runabouts. The security bond will be processed within 20 days of the termination of the charter. (If major damage occurred the 20 days could be extended & charterer will be notified.) The following costs (if applicable) will be charged to your credit card or deducted from the Security Bond paid:

  • Loss or damage to charter vessel or equipment (moorings included).
  • Cost of refuelling the vessel with diesel or petrol.
  • Cleaning of the vessel if returned in an unreasonable state.
  • Defrayment of costs due to vessel not being returned at scheduled time. Extenuating weather conditions are exempt.
  • Clean/maintenance Fees: If toilets are blocked by sanitary pads or other foreign items.
  • Any other outstanding debits on the client account (fishing tackle hire, tuition fees etc)
3. Insurance:
All vessels are fully insured against fire - marine & collision risks - third party liability. If during the charter period damage or loss is caused the charterer is liable as follows:
  • To the full extent of loss and damage which in Compass Charters opinion is not claimable against vessel insurers.
  • To pay full excess on vessel insurance policy.
  • To pay full amount of loss or damage should the claim be declined by the Insurance Company for any reason.
  • All equipment supplied is used by charter party at their own risk.
  • In case of an Insurance claim, fuel used and other outstanding debits (if applicable) will be charged in addition to the Security Bond.
4.

Skippered charters:
Any damages occurred at which the members of the charter party are the only ones to blame (the skipper is not at fault), will be charged to the clients account and charged to their credit card. Another payment method can be arranged.

All passengers to abide by the skipper and crews instructions. All persons under 18 to be supervised by an adult.

 

Note :  This agreement will have to be signed off before or on arrival for the charter. No signed agreement can result in the charter not taking place and no refund will be appliccable.
